Can criticizing the boss on Facebook get you fired?
Information may want to be free, as the old Internet adage goes--but how far does such freedom extend when it comes to criticizing your boss on social media platforms? That's the question that the National Labor Relations Board is putting before an administrative law court. NLRB lawyers are contending that a Connecticut-based ambulance service illegally fired an emergency medical technician after she criticized her supervisor on Facebook, the New York Times reports. The case could have broad implications for workers' speech rights as applied to social media. [Related: Six things you should never reveal on Facebook] According to the complaint, Dawnmarie Souza was fired after using vulgarities to ridicule her supervisor in a Facebook post. Souza also wrote, using the company's terminology for a psychiatric patient: "Love how the company allows a 17 to become a supervisor." Souza and the supervisor had clashed after the supervisor would not let a union representative help her to prepare a response to a customer's complaint about her work. The company, American Medical Response, says it has a policy that bars employees from depicting the company on Facebook and other social media sites on which they post pictures of themselves. The NLRB argues that the rule is overly broad--and that the firing of Souza violates the National Labor Relations Act, which, among other things, prohibits employers from punishing workers for discussing working conditions or unionization. The complaint notes that the comments triggered supportive responses from Souza's co-workers, as well as additional negative comments about the supervisor. "This is a fairly straightforward case under the National Labor Relations Act," a lawyer for the NLRB told the Times. "Whether it takes place on Facebook or at the water cooler, it was employees talking jointly about working conditions, in this case about their supervisor, and they have a right to do that." But American Medical Response said the firing was proper. "The employee in question was discharged based on multiple, serious complaints about her behavior," the company said in a statement. "The employee was also held accountable for negative personal attacks against a co-worker posted publicly on Facebook. The company believes that the offensive statements made against the co-workers were not concerted activity protected under federal law." An administrative law judge will begin hearing the case Jan. 25.

one colleague of mine who worked for a large retail company complained about them on facebook he was on a management development programe and was take off it for his comments on facebook and we have since been told that the company do employ colleagues to scower sites such as facebook for key words such as company names ect and that any such status' envolving the company name will go to disaplinery and could leed to dismissal. No exactly freedom of speach no is it?!

In the UK teachers in schools can be asked to resign in certain circumstances for posting on Facebook et al. Also large companies insist that employees sign an agreement not to publish anything on the net which might be harmful (broad definition) to the company.

I don't know if you're asking this as a poll or simply to know how we think of the topic. Anyway, I think you can be sued anywhere on the Web, be it Facebook or not, if you do these things: 1. Libel 2. Copyright Infringement 3. Privacy Violations 4. Harassment 5. Breach of Contract It seems that the case falls under item No.1 so I guess, there is a chance that the boss will win the case. This is my opinion though. I think, people forget proper netiquette these days like the 2nd source below.

Honestly, I think she should get fired. I think one of the biggest misconceptions about facebook is that it is private. In no way is facebook anyway similar to a water cooler. Did you know that almost everyone on facebook is connected with one another in less than 7 degrees of separation? That is what makes websites like facebook so valuable to companies for marketing. They can post something on facebook and it could spread like wild fire across the web for little or no money. The same thing can happen to an individuals wall posts in theory. Facebook should not be thought of as a private profile that only your friends can see. Sure it is a great way to keep track of your personal friends but in many ways it is not private. In all reality it is a public blog of sorts. Would it have been worse if she went out on a public news blog and made those statement? Employees need to be aware of the impact they can have for the companies they work for by making negative statements and I truly believe that if you are a business owner you should train your employees how to act when talking about there employer so you don't cause a PR nightmare like this one.

I watch the Marblehornets videos on youtube, and I joined a facebook group discussing the different characters and who they are. One of the characters is called Slenderman, and he is a very tall man dressed in a suit and tie. Where his face should be there is just blank, empty skin. He isn't real, of course. These videos are made for entertainment. But someone left a comment on that facebook page that said, "I think the Slenderman myth is based on one of several inter-dimensional beings that came through a rift in central Connecticut a few hundred years back. The rift itself is on heavily guarded land now." I thought this sounded very interesting, and I tried to google it to read more about this rift and what supposedly came out of it, but couldn't find anything. I was wondering if anyone could tell me more about it or give me some keywords or maybe even the name of the rift so I could search for it and read about it. Or even if you know any information about this and would like to share it with me that would be awesome. Thank you! *I went to this person's page to send them a message asking them about it, but they have a note on their info section saying that they won't be able to get back on facebook until September.

its possible you wont find anything about the rift, because there are still people that dont believe in paranormal occurences, and dismiss it as fantasy or psychosis.

There are many rifts and vortexes that have appeared and closed throughout the years. The Slenderman is actually based on a spirit that was said to haunt a light house in Conn. He was a tall man skeletal in shape and had a blank face. As the story goes if you saw his true face you died soon after. I am not sure how true this is but I have heard the story.

Why was this teacher suspended?
Old news yeah but I just found it and am a bit concerned.. http://www.charlotteobserver.com/2010/02/16/1250606/facebook-venting-ensnares-teacher.html Reading the -entire- article you can see that the teacher was clearly the victim here. She is teaching science not mythology. She did nothing wrong. Being harassed can drive anyone insane. Teachers are no less human than any of us and everyone has a breaking point. Those brainwashed hellions drove her up the walls and should be expelled for mental abuse of a public servant. They clearly were forcing their beliefs on her, not much different from any other incident in history, for example, the Salem Witch Trials, the Spanish Inquisition, and other atrocious events in human history. I encourage anyone who experiences such oppression to alert the proper authorities if applicable and request that action be taken to prevent such an incident again. The teacher should not suffer any penalty in my humble opinion. Perhaps sending them to the office for asking about 'gods' role in evolution was a bit much but that can easily be addressed without firing/suspending her. The kids should be suspended and reassigned to another teacher, or they should be expelled. This sort of abuse is often overlooked because it is minors harassing an adult. But anyone can be abused by anyone. It is a fact. Age should not be a reason for special privileges if said offender has a rational level of thought and action. These children clearly do. All religions should have the same limitations. Telling others about your faith is one thing, oppressing them into conversion is another, and should be put to a stop wherever, whenever, it occurs, regardless of the faith in question. Religion should be kept entirely out of schools unless you are attending the proper class. Mythology or any other class that discusses myths/legends/fairy tales are a different story. NOTE: I am speaking from my own views based on FACTS and things that are tangible. I have read physical evidence that states that this occurrence has happened. Quoting unproven scripture from unproven cults is not going to answer my question. My information is based on logic, not unproven stories/teachings from mythological figures. Please refrain from dogmatic preaching. I do not want or need it. If you have an answer that is based on non religious logic/reasoning and is on topic, I highly anticipate your answer, She was -not- discriminating. You are a biased christian yourself! Read the thing and you will see that yes, she may have mad a few mistakes, but she was being harassed. Think about it logically. Breaking points. We have them. Continuous harassment causes such points to be breached, as is the case her. You do not have the religious right to continually harass someone. That is unethical, regardless of what your god tells you. And what she says on her facebook, out of school, on her -own- time is her business and should not be grounds for termination. Since when do the rules of a single establishment apply to its employees personal opinions and views when they are expressed during off duty hours and off of school grounds? It's ridiculous!

No the teacher deserves to get fired. The kids have a freedom to religion and she said she treats them differently and went into detail about it. That is religious discrimination. Further more she was belittle the kids and judging them by their families political opinions. I bet if you look deep into this one she unfairly down graded christian/conservative kids grades. Souly because of that. The teacher a religious bigot.

As a science teacher at the high school level, I understand the ignorance of some parents and students. However, you should never talk about your students on a public Facebook page. Period. That is just plain stupid.

Those students were blatantly teasing and antagonizing her just because she isn't religious, and were disrupting the class with their hymn singing. Questions about God and "creation" have no place in a science class, and I could understand her getting annoyed when they kept putting Bibles on her desk. She had every right to discipline those little turds. Unfortunately, the Christians in the American south can pretty much get away with such religious harassment.

Why the secret service is investigating itself, the white house is investigating and the couple are not discussing that the husband and Obama worked at the Univ of Chicago together and he worked on Obama's campaign - they know eachother and they act like they've never met! My first love....please I need advice!?
My first love....please I need advice!?
Without going into a life story let me just try to keep this to an overview of a few of my thoughts and feelings....I met my first love back in my teenage years, it was a night I will never forget. The night started out like any other night as a teenager, no real plans and not looking for a girlfriend at all. I arrived at the local skating rink on a Friday night, met up with friends and the night started. It was not long before this brown hair brown eyed beauty caught my eye...but she was way out of my league. I watched her throughout the night scared to death to actually approach her. After much convincing from my friends talking me up and telling me if I really liked her to go talk to her I did, knees shaking, stomach doing circles trying to remain calm I approached her to ask her to skate with my for the slow skate. She told me she was waiting for another guy she was supposed to meet up with during the second session but she would skate with me. The song was You Are Not Alone by MIchael Jackson I remember it like yesterday! The night went on and we really hit it off, completely inseparable from one another. This other guy finally arrived and was late and her lost the chance at the only girl that has touched my life like this. We talked on the phone that night and many nights to come falling asleep talking to one another on the phone at all hours of the morning. Fast forward a few years we have dated a few times by now and it has finally stopped, she has fallen for someone else. We remained friends and we went to one another to talk about all of our problems included relationships, we got eachother through a lot of tough times. It always killed me to hear she was dating someone else. Now skip another 8 years to Valentines day this year, my wife and I go into buy a couch and who is the sales person that comes up to us......yep you guessed it. We have not talked in probably years to this point, although I literally think about her daily and wish it would have never ended. I really understand the meaning of love and it is thanks to this girl I got it, however I have never felt it with anyone else...I miss her and think about her 24/7 I know some of you will say let it go you both moved on, but truth be told I don't think I really ever have. I added her on facebook a few days after running into her again and we chatted for a little while she started telling me about problems with her marriage and then just stopped and asked why she was telling me all of this...it was like time just went back a decade there for a minute and we were talking about our relationship problems again. I love her and I am married, I just need some advise. If your advise is "you are married, drop it with her" or anything of that sort then save it and keep it to yourself. I hate to be mean here but I really cannot leave the thought of us getting back together alone it has been over a decade and I long to see her, hear her voice and just think about her EVERY SINGLE DAY. I have no one I can tell this too or talk about with so you guys are it. Please help me. I wrote an annomous note the other day telling her all of my feelings for her with an email address to reply to if she is interested in figuring out who it is from. I am going ot leave it on her car for her to find, she can then do what she wants with it...but I really hope I hear something back. Comments and advise are welcome...............please you are all I have as I cannot even discuss the thought of all of this with anyone in my life, and it has been consuming me for over a decade. This is just not some random girl but more like what I believe to be my soulmate! Thanks guys!!!!

First, I would like to know if you have any kids. I know you didn't mention them, but that doesn't mean you don't have any. I'm not going to lie, I think it's a bad idea. Are you completely sure of your feelings? Could it be that maybe you just didn't get closure? Maybe you've idealized her beyond and realistic standards. I've done that before and it was horrible. It came to the point that there was no way she could meet up to what I imagined being with her would be like. I'd hate to know that you threw away a marriage for that. You need to think logically about all of this. I know that would be hard to do, but sometimes emotions get the better of us. If you are absolutely sure of what you are feeling, well, it's not fair to your wife. But you should know there is a VERY good chance that she will hate you for this. Just don't go off half cocked. Think everything out. Be patient and make sure this is what's right. I hope you have the best of luck with whatever you decide.

You seem to have already made your mind up of what you want. Why did she break it off to begin with when you were dating? I'd take a good look at what you have now and figure out if its worth to risk it on a maybe. First real loves last with everyone that has them, you aren't the only one, but try and be realistic and figure out if it's actually possible before you go putting a mushy note on her car. I wish you luck. You have some soul searching to do that is for certain.

I had the same problem, but, well, if you don't want to be told to move on, then think of why you married your wife and how hurt you would be if she acted on similar feelings for her first love. It's time to reevaluate your life when these situations arise. Could you live happily without your wife or after you have hurt her? Or would you really throw it all away? Maybe you would, you said nothing about your marriage. I think this kind of situation occurs more than you think.

I know what you mean I fell for two females I really do love them but they are married we been friends for years, They know I love them their husbands know I love them and I happy they are in my life At some stage in life we really do find true love and have to play the cards we are dealt. I'm now an old man and it's easier for me to be happy that they are where they need to be and well taken care of. It may be a different story if I was younger. She could be your soul mate under different circumstances. I have never felt this close to anyone as I feel to these to ladies. I put my arms around them and it's damn hard to let go but have nothing but their best interest at heart.

What is the best course of action for a dispute like this?
About a year ago, I loaned someone about 200 dollars worth of DVDs (House seasons 1 - 4) so he could watch them. I've been asking for them since and he keeps promising he'll give them to me but he never does. About two months ago, he invited a friend I was with to dinner. When my friend told him he was already out, he wanted me to go, but I had no money -- so he fronted me 14 dollars for dinner. He knows I don't have cash -- I am in so much trouble right now I can't even pay my rent, my car note, my utilities, my credit card bills, nothing. I skipped all my bills this month so I could buy myself food. I DID, however, get a job offer (a NICE one) and I made some comment on Facebook about getting a "sweet job offer." 12am, the guy calls me and I answer the phone and the first thing I hear is, "What job offer?" I respond that I'm not willing to discuss that and chuckle, and he snaps "Like your not going to give me my money like I won't give you your DVDs." He immediately hangs up before I can even explain myself. I repay my debts. But the money just physically isn't there. On the other hand, I've been very kind and patient with him for over a year. That phone call, being treated like that.. enough is enough. I live in Tempe, Arizona. I am NOT familiar with the area or the legal system, but would anyone know how much would it put me out to try and take action against this guy for the return of my DVDs or their cash value? I did not have a contract or anything, it was just a friendly gesture.

First pay him the $14 so that's out of the way. Then tell him unless he returns the DVD's you will take him to Small Claims Court - if he doesn't, go ahead with it. The local Clerk of the Courts office should be able to help you.

Go to small claims court and ask if you can petition your discs. Also try and put a dollar amount on theses CD's to give the judge the amount you are out. It sounds like your friend has never attempted to give them back. Also try and remember what order they were in, and a small description of your address book ? Then and only them I recommend seeing a lawyer who like those kinds of details.
